Contentious Insolvency

The Contentious Insolvency Team comprises specialists from our business restructuring and forensic teams, working as an integrated unit in contentious cases involving litigation, fraud and asset tracing.

Our dedicated team includes Licensed Insolvency Practitioners, forensic accountants and computing experts, former banking professionals and law enforcement officers, financial investigators and regulators, and in-house lawyers.

What we do

Our experienced team focuses on cases ranging from small local assignments through to complex cross border insolvencies.  These cases may typically involve obtaining initial freezing injunctions in the case of suspected fraud, asset tracing and investigation, contractual claims, negligence and using powers provided by the insolvency legislation to pursue misfeasance, preference and undervalue transaction claims.

 Staged Approach

We have successfully made recoveries based on a variety of causes of action across a diverse range of businesses around the world, from sources including directors, customers and suppliers, auditors and other professional advisors, associated companies and even foreign governments.

The services provided by our Contentious Insolvency Team include corporate and personal insolvency appointments, Proceeds of Crime Act appointments, and fraud investigations.

Who we can help

We are working closely with the whole range of stakeholders that may be exposed to contentious insolvency situations – banks, ABLs, alternative lenders and funds, landlords and suppliers, shareholders, government departments and regulators.
